These Terms of Service, together with the details on your waybill, shipping label, and receipt, form the Conditions of Carriage between you ("Shipper" or "Consignee") and SkyNet Kenya Couriers Limited, trading as SkyNet Worldwide Express ("SkyNet", "we", "us"), a company headquartered at Vision Plaza, Mombasa Road, Nairobi, Kenya (KRA PIN P052178317Y).
1. Acceptance of Terms
By booking a shipment with us, signing a waybill, using our website or customer portal, or tendering a parcel for carriage, you accept these Terms in full. If you do not agree, please do not use our services.
2. Definitions
- "Waybill" means the air waybill / consignment note (in paper or electronic form) evidencing the contract of carriage for a shipment.
- "Shipper" means the person or business tendering a shipment for carriage.
- "Consignee" means the intended recipient of a shipment.
- "Shipment" means the parcel(s), document(s), or freight tendered under a single waybill.
- "Charges" means all fees payable for carriage, including freight, fuel surcharge, VAT, duties, and any additional services.
3. Our Services
We provide domestic express, international freight, same-day delivery, e-commerce fulfilment, and customs clearance services as described on our Services page. Service availability, transit times, and coverage vary by origin, destination, and product selected, and quoted transit times are estimates unless a specific service expressly guarantees delivery by a stated time.
4. Booking & the Waybill
The Shipper is responsible for the accuracy and completeness of all information provided for the waybill and shipping label, including sender and recipient details, description of contents, weight, dimensions, and declared value. We may rely on this information without independently verifying it, and the Shipper indemnifies us against losses arising from inaccurate or incomplete information.
5. Prohibited & Restricted Items
Unless we have given prior written approval, you must not tender for carriage:
- Cash, currency, negotiable instruments, or bearer securities.
- Firearms, ammunition, explosives, or weapons of any kind.
- Illegal drugs, narcotics, or psychotropic substances.
- Hazardous, flammable, corrosive, or radioactive materials.
- Counterfeit goods or items that infringe intellectual property rights.
- Perishable goods, live animals, or human remains, unless specifically agreed with us in advance.
- Any item whose carriage, import, or export is prohibited by the law of the origin, transit, or destination country.
We may refuse, hold, return, or — where required by law or for safety reasons — dispose of any shipment that breaches this clause, at the Shipper's cost.
6. Inspection & Customs
We may open and inspect any shipment where reasonably necessary for security, customs, or legal compliance purposes. The Consignee (or Shipper, depending on the agreed delivery terms) is responsible for all customs duties, taxes, and clearance charges, and for complying with KRA and destination country import/export regulations. We may hold a shipment until duties and charges are settled.
7. Charges & Payment
Charges are based on our published tariff or your quote, actual or volumetric weight (whichever is greater), destination zone, applicable fuel surcharge, and VAT at the prevailing rate. Charges are payable by the Shipper, Consignee, or a third party as specified on the waybill, using M-Pesa, card, wallet, or an approved credit account. We may suspend services or hold shipments where payment is overdue.
8. Delivery
We will attempt delivery to the address provided. Where no one is available to receive a shipment, we may leave it with an authorised person at that address, attempt redelivery, or hold it at a local branch, subject to storage charges. Shipments that remain undeliverable after a reasonable period (typically 30 days) may be returned to the Shipper or disposed of in accordance with law, at the Shipper's cost.
9. Liability
Our liability for loss of or damage to a shipment is limited to the lower of the shipment's actual value or the maximum amount recoverable under our standard tariff, unless you have purchased additional declared-value insurance or extended liability cover under Clause 10. We are not liable for:
- Indirect, consequential, or economic loss (including loss of profits or business).
- Delay, except under a service that expressly guarantees a delivery time.
- Loss or damage caused by the inherent nature of the goods, inadequate packaging, prohibited items, force majeure, or compliance with customs/government instructions.
- Loss or damage arising from inaccurate information supplied by the Shipper.
10. Insurance & Extended Liability
You may request declared-value insurance, charged at 2% of the declared value, or purchase extended liability cover at the fee shown at booking. These optional charges appear as separate line items on your receipt and increase our maximum liability for that shipment up to the declared value, subject to the policy terms communicated at the time of purchase.
11. Claims
Any claim for loss, damage, or delay must be made in writing within 30 days of the shipment date (or expected delivery date), accompanied by the waybill number, proof of value, and — for visible damage — photographs taken at the time of delivery. Claims received after this period may be declined.
12. Account & Portal Terms
If you register for a SkyNet portal or business account, you are responsible for keeping your login credentials confidential and for all activity under your account. We may suspend or close accounts used fraudulently, abusively, or in breach of these Terms. Use of our Developer API is additionally governed by our API documentation.
13. Intellectual Property
The SkyNet name, logo, and website content are owned by SkyNet Worldwide Express / Deluca Group Holdings and may not be used without our prior written consent.
14. Force Majeure
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, civil unrest, strikes, government action, or disruption to air, road, or sea transport networks.
15. Governing Law & Changes
These Terms are governed by the laws of the Republic of Kenya, and disputes are subject to the exclusive jurisdiction of the courts of Nairobi. We may update these Terms from time to time; continued use of our services after an update constitutes acceptance of the revised Terms.
